국세기본법 제16조(근거과세)

① 납세의무자가 세법에 따라 장부를 갖추어 기록하고 있는 경우에는 해당 국세 과세표준의 조사와 결정은 그 장부와 이와 관계되는 증거자료에 의하여야 한다. <개정 2020.6.9>

② 제1항에 따라 국세를 조사ㆍ결정할 때 장부의 기록 내용이 사실과 다르거나 장부의 기록에 누락된 것이 있을 때에는 그 부분에 대해서만 정부가 조사한 사실에 따라 결정할 수 있다.

③ 정부는 제2항에 따라 장부의 기록 내용과 다른 사실 또는 장부 기록에 누락된 것을 조사하여 결정하였을 때에는 정부가 조사한 사실과 결정의 근거를 결정서에 적어야 한다.

④ 행정기관의 장은 해당 납세의무자 또는 그 대리인이 요구하면 제3항의 결정서를 열람 또는 복사하게 하거나 그 등본 또는 초본이 원본(「전자문서 및 전자거래 기본법」 제5조제2항에 따른 전자화문서로 보관하고 있는 경우에는 그 전자화문서를 포함한다)과 일치함을 확인하여야 한다. <개정 2026.6.2>
