국토의 계획 및 이용에 관한 법률 제35조의7(공간재구조화계획 결정의 효력 등)

① 공간재구조화계획 결정의 효력은 지형도면을 고시한 날부터 발생한다. 다만, 지형도면이 필요 없는 경우에는 제35조의6제3항에 따라 고시한 날부터 효력이 발생한다.

② 제1항에 따라 고시를 한 경우에 해당 구역 지정 및 계획 수립에 필요한 내용에 대해서는 고시한 내용에 따라 도시ㆍ군기본계획의 수립ㆍ변경(제19조제1항 각 호 중에서 인구의 배분 등은 대통령령으로 정하는 범위에서 변경하는 경우로 한정한다)과 도시ㆍ군관리계획의 결정(변경결정을 포함한다) 고시를 한 것으로 본다.

③ 제1항에 따른 지형도면 고시 등에 관하여는 제32조를 준용한다. 이 경우 "도시ㆍ군관리계획"은 "공간재구조화계획"으로 본다.

④ 제1항에 따라 고시를 할 당시에 이미 사업이나 공사에 착수한 자(이 법 또는 다른 법률에 따라 허가ㆍ인가ㆍ승인 등을 받아야 하는 경우에는 그 허가ㆍ인가ㆍ승인 등을 받아 사업이나 공사에 착수한 자를 말한다)는 그 공간재구조화계획 결정과 관계없이 그 사업이나 공사를 계속할 수 있다.

⑤ 제1항에 따라 고시된 공간재구조화계획의 내용은 도시ㆍ군계획으로 관리하여야 한다.
