국회법 제48조의2(이해충돌 위원의 선임 제한)

① 의장과 교섭단체 대표의원은 의원의 이해충돌 여부에 관한 제32조의3제1항에 따른 윤리심사자문위원회의 의견을 고려하여 의원을 위원회의 위원으로 선임하는 것이 공정을 기할 수 없는 뚜렷한 사유가 있다고 인정할 때에는 그 의원을 해당 위원회의 위원으로 선임하거나 선임을 요청하여서는 아니 된다.

② 윤리심사자문위원회는 위원이 소속 위원회 활동과 관련하여 이해충돌이 발생할 우려가 있으면 의장의 요청 또는 직권으로 위원의 이해충돌 여부를 검토하여 의장, 해당 의원 및 소속 교섭단체 대표의원에게 그 의견을 제출할 수 있다.

③ 의장과 교섭단체 대표의원은 윤리심사자문위원회로부터 제2항, 제32조의3제2항제4호 및 제32조의4제2항에 따라 위원이 소속 위원회 활동과 관련하여 이해충돌이 발생할 우려가 있다는 의견을 받은 경우 해당 위원이 직무에 공정을 기할 수 없다고 인정하면 해당 위원을 개선하거나 개선하도록 요청할 수 있다.

④ 의장과 교섭단체 대표의원은 위원의 선임ㆍ선임요청 또는 개선ㆍ개선요청과 관련하여 윤리심사자문위원회에 이해충돌 여부에 관하여 자문을 요청할 수 있다.
