근로복지기본법 시행령 제17조(조합기금의 사용)

①조합은 법 제36조제3항에 따라 조합기금을 사용할 때 직전 회계연도 말까지 적립된 기금(법 제42조제1항에 따른 차입금의 상환 및 그 이자 지급에 사용하는 금액은 제외한다)은 해당 회계연도가 시작된 후 6개월 이내에 우리사주 취득에 사용하여야 한다. 다만, 우리사주가 관리종목으로 지정되는 등 고용노동부령으로 정하는 사유가 있는 경우에는 그러하지 아니하다. <개정 2016.1.19>

② 조합은 제1항 본문에도 불구하고 조합원이 1년 이상 3년 이내의 기간 동안 일정금액을 조합기금에 출연하기로 조합과 약정하여 그 약정에 따라 출연한 경우에는 그 약정에 따라 출연한 금전(우리사주제도 실시회사가 조합원의 출연에 대응하여 함께 금전을 출연하기로 조합과 약정한 경우에는 그 금전을 포함한다)을 약정한 기간의 종료일이 속하는 회계연도의 다음 회계연도가 시작된 후 6개월 이내에 우리사주 취득에 사용하여야 한다. <신설 2016.1.19>
