근로복지기본법 제77조(분할등의 효력발생ㆍ효과)

① 기금법인의 분할등은 분할등으로 인하여 설립되는 기금법인의 설립등기 또는 존속하는 기금법인의 변경등기를 함으로써 그 효력이 생긴다.

② 분할등으로 인하여 설립되거나 존속하는 기금법인은 분할계획서 또는 분할합병계약서에서 정하는 바에 따라 분할되는 기금법인의 권리ㆍ의무를 승계한다.
