근로복지기본법 제76조(분할등에 의한 기금법인의 설립 및 등기)

① 기금법인의 분할등으로 인하여 기금법인을 설립하는 경우에는 사업의 분할ㆍ분할합병 등으로 인하여 설립되는 사업의 사업주가 준비위원회를 구성하여 제52조에 따른 기금법인의 설립절차를 거쳐야 한다.

② 기금법인의 분할등으로 인하여 존속하는 기금법인은 변경등기를, 소멸하는 기금법인은 해산등기를 하여야 한다.
