근로자퇴직급여 보장법 시행령 제17조(개인형퇴직연금제도의 설정 대상)
Enforcement Decree of the Employee Retirement Benefit Security Act, Article 17 (Persons Eligible to Establish Individual Retirement Pension Plans)
법 제24조제2항제3호에서 "자영업자 등 안정적인 노후소득 확보가 필요한 사람으로서 대통령령으로 정하는 사람"이란 다음 각 호의 사람을 말한다.
"A person prescribed by Presidential Decree who needs to secure stable income after retirement, such as a self-employed person" in Article 24 (2) 3 of the Act means the following persons:
1. 자영업자
1. A self-employed person;
2. 법 제4조제1항 단서에 따라 퇴직급여제도가 설정되어 있지 아니한 다음 각 목의 어느 하나에 해당하는 근로자
2. Any of the following employees for whom no retirement benefit plan has been established under the proviso to Article 4 (1) of the Act:
가. 계속근로기간이 1년 미만인 근로자
(a) An employee whose period of continuous service is less than one year;
나. 4주간을 평균하여 1주간의 소정근로시간이 15시간 미만인 근로자
(b) An employee whose contractual working hours, averaged over four weeks, are less than 15 hours per week;
3. 법 제8조제1항에 따른 퇴직금제도를 적용받고 있는 근로자
3. An employee covered by the severance pay plan under Article 8 (1) of the Act;
4. 「공무원연금법」의 적용을 받는 공무원
4. A public official covered by the Public Officials Pension Act;
5. 「군인연금법」의 적용을 받는 군인
5. A military service member covered by the Military Pension Act;
6. 「사립학교교직원 연금법」의 적용을 받는 교직원
6. A teacher or staff member covered by the Private School Teachers' Pension Act;
7. 「별정우체국법」의 적용을 받는 별정우체국 직원
7. An employee of a special post office covered by the Special Post Offices Act.
