근로자퇴직급여 보장법 제35조(사용자에 대한 감독)

① 고용노동부장관은 사용자가 퇴직연금제도의 설정 또는 그 운영 등에 관하여 이 법 또는 퇴직연금규약 및 중소기업퇴직연금기금표준계약서에 위반되는 행위를 한 경우에는 기간을 정하여 그 위반의 시정을 명할 수 있다. <개정 2021.4.13>

② 고용노동부장관은 사용자가 제1항에 따른 기간 이내에 시정명령에 따르지 아니하는 경우에는 퇴직연금제도 운영의 중단을 명할 수 있다.
