기초연금법 시행령 제4조(선정기준액의 기준 등)

① 법 제3조제1항에 따라 보건복지부장관이 정하여 고시하는 금액(이하 "선정기준액"이라 한다) 및 법 제5조의2제2항에 따라 보건복지부장관이 정하여 고시하는 금액(이하 "저소득자 선정기준액"이라 한다)은 65세 이상인 사람 및 그 배우자(이하 이 조에서 "노인가구"라 한다)의 소득ㆍ재산 수준과 생활실태, 물가상승률 등을 고려하여 산정한다. <개정 2019.3.26>

② 배우자가 있는 노인가구의 선정기준액 및 저소득자 선정기준액은 배우자가 없는 노인가구의 선정기준액 및 저소득자 선정기준액에 100분의 160을 곱한 금액으로 한다. <개정 2019.3.26>

③ 배우자가 「주민등록법」 제7조의2제1항에 따른 주민등록번호, 「출입국관리법」 제31조제5항에 따른 외국인등록번호, 「부동산등기법」 제49조제1항제2호에 따라 부여하는 부동산등기용등록번호 등 보건복지부장관이 정하는 고유식별정보가 없어 법 제11조에 따른 조사ㆍ질문이 어려운 경우에는 제2항에도 불구하고 배우자가 없는 노인가구의 선정기준액 및 저소득자 선정기준액을 적용한다. <개정 2017.6.27, 2018.8.28, 2019.3.26>

④ 해당 연도 선정기준액 및 저소득자 선정기준액은 전년도 12월 31일까지 보건복지부장관이 결정ㆍ고시하고, 1월 1일부터 12월 31일까지 적용한다. <개정 2019.3.26>

⑤ 보건복지부장관은 제1항에 따라 선정기준액 및 저소득자 선정기준액을 정할 때에는 기획예산처장관 등 관계 중앙행정기관의 장과 협의해야 한다. <개정 2019.3.26, 2025.12.30>
