기초연금법 제5조의2(저소득 기초연금 수급권자에 대한 기초연금액 산정의 특례)

① 제5조제2항 전단에도 불구하고 65세 이상인 사람 중 소득인정액이 100분의 40 이하인 사람에게 적용하는 기준연금액은 30만원으로 한다. <개정 2020.1.21>

② 보건복지부장관은 제1항의 기준연금액을 적용받는 사람을 선정하기 위한 소득인정액(이하 "저소득자 선정기준액"이라 한다)을 정하여 고시하여야 한다.

③ 저소득자 선정기준액의 기준, 고시 시기 및 적용기간 등은 대통령령으로 정한다.
