노인복지법 제39조의18(위반사실의 공표)

① 보건복지부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제39조의9의 금지행위로 제60조에 따른 처벌을 받은 법인 등이 운영하는 시설에 대하여 그 위반행위, 처벌내용, 해당 법인 또는 시설의 명칭, 대표자 성명, 시설장 성명(대표자와 동일인이 아닌 경우만 해당한다) 및 그 밖에 다른 시설과의 구별에 필요한 사항으로서 대통령령으로 정하는 사항을 공표할 수 있다. 이 경우 공표 여부를 결정할 때에는 그 위반행위의 동기, 정도, 횟수 및 결과 등을 고려하여야 한다.

② 보건복지부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제39조의14에 따른 처분을 받거나 제55조의2ㆍ제55조의3제1항제2호 또는 제55조의4제1호에 따른 처벌을 받은 자로서 제39조의9에 따른 금지행위로 노인의 생명을 해치거나 신체 또는 정신에 중대한 피해를 입힌 노인복지시설의 장과 종사자에 대하여 법 위반 이력과 명단, 그 밖에 대통령령으로 정하는 사항을 공표할 수 있다. 이 경우 공표여부를 결정할 때에는 그 위반행위의 동기, 정도, 횟수 및 결과 등을 고려하여야 한다. <개정 2016.12.2>

③ 보건복지부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제1항 및 제2항에 따른 공표를 실시하기 전에 공표대상자에게 그 사실을 통지하여 소명자료를 제출하거나 출석하여 의견진술을 할 수 있는 기회를 부여하여야 한다.
