대부업 등의 등록 및 금융이용자 보호에 관한 법률 제18조의11(처분 등의 기록 및 공시 등)

① 금융위원회는 제18조의10에 따라 처분 또는 조치한 경우에는 그 내용을 기록하고 이를 유지ㆍ관리하여야 한다.

② 금융위원회는 협회의 퇴임한 임원 또는 퇴직한 직원이 재임 또는 재직 중이었다면 제18조의10제2항제1호부터 제5호까지 또는 같은 조 제3항제1호부터 제6호까지에 해당하는 조치를 받았을 것으로 인정되는 경우에는 그 받았을 것으로 인정되는 조치의 내용을 금융감독원장으로 하여금 협회에 통보하도록 할 수 있다. 이 경우 통보를 받은 협회는 이를 퇴임ㆍ퇴직한 그 임직원에게 통보하여야 한다.

③ 제1항은 협회가 금융위원회의 조치요구에 따라 그 임직원을 조치한 경우 및 제2항에 따라 통보를 받은 경우에 준용한다.

④ 협회 또는 그 임직원(임직원이었던 자를 포함한다)은 금융위원회에 자기에 대한 제18조의10에 따른 처분 또는 조치 여부 및 그 내용을 조회할 수 있다.

⑤ 금융위원회는 제4항의 조회요청을 받은 경우에는 정당한 사유가 없으면 처분 또는 조치 여부 및 그 내용을 그 조회 요청자에게 통보하여야 한다.
