도로교통법 시행령 제14조(보관한 차의 매각 또는 폐차 등)

① 경찰서장, 도지사 또는 시장등은 법 제35조제5항에 따라 차를 매각하거나 폐차하려는 경우에는 미리 그 뜻을 자동차등록원부에 적힌 사용자와 그 밖의 이해관계인에게 통지하여야 한다.

② 경찰서장, 도지사 또는 시장등은 법 제35조제5항에 따라 차를 매각하는 경우에는 다음 각 호의 어느 하나에 해당하는 경우를 제외하고는 「국가를 당사자로 하는 계약에 관한 법률」에서 정하는 바에 따라 경쟁입찰로 하여야 한다.

③ 경찰서장, 도지사 또는 시장등은 차의 재산적 가치가 적어 제2항에 따른 경쟁입찰 등의 방법으로 차가 매각되지 아니한 경우에는 그 차를 폐차할 수 있다.

④ 경찰서장, 도지사 또는 시장등은 차를 매각한 경우에는 다음 각 호의 사항이 포함된 매각결정서를 매수인에게 발급하여야 하며, 차를 폐차한 경우에는 관할 관청에 그 말소등록을 촉탁(囑託)하여야 한다.
