도로교통법 시행령 제52조(외국면허증 소지자에 대한 운전면허시험의 일부 면제)

① 법 제84조제2항 본문에 따른 외국면허증(그 운전면허증을 발급한 국가에서 90일을 초과하여 체류하면서 그 체류기간 동안 취득한 것으로서 임시면허증 또는 연습면허증을 제외하며, 이하 "외국면허증"이라 한다)을 가진 사람에 대한 운전면허시험의 일부면제에 관한 사항은 별표 3과 같다. <개정 2022.4.19>

② 법 제84조제2항 단서에서 "외교, 공무 또는 연구 등 대통령령으로 정하는 목적으로 국내에 체류하고 있는 사람"이란 「출입국관리법 시행령」 별표 1 및 별표 1의2에 따른 국내에서의 체류자격이 외교ㆍ공무ㆍ협정ㆍ주재ㆍ기업투자ㆍ무역경영ㆍ교수ㆍ연구ㆍ기술지도ㆍ특정활동 또는 재외동포인 사람과 그 배우자 및 19세 미만의 자녀로서 배우자가 없는 사람을 말한다. <개정 2018.9.18>

③ 외교부장관은 대한민국 운전면허증을 가진 사람에게 적성시험을 제외한 모든 운전면허시험 과정을 면제하는 국가(이하 "국내면허 인정국가"라 한다)를 연 1회 이상 조사하고, 그 결과를 경찰청장에게 통보하여야 한다.

④ 경찰청장은 제3항에 따라 외교부장관으로부터 국내면허 인정국가를 통보받은 경우에는 국내면허 인정국가의 범위를 확인하여 이를 고시하여야 한다.
