독점규제 및 공정거래에 관한 법률 제82조(조사시간 및 조사기간)

① 조사공무원은 제80조 및 제81조에 따른 조사를 하는 경우에는 조사를 받는 사업자 또는 사업자단체의 정규 근무시간 내에 조사를 진행하여야 한다. 다만, 증거인멸의 우려 등으로 정규 근무시간 내의 조사로는 조사의 목적을 달성하는 것이 불가능한 경우에는 피조사업체와 협의하여 정규 근무시간 외의 시간에도 조사를 진행할 수 있다.

② 조사공무원은 제81조제9항의 문서에 기재된 조사기간 내에 조사를 종료하여야 한다. 다만, 조사기간 내에 조사목적 달성을 위한 충분한 조사가 이루어지지 못한 경우에는 조사를 받는 사업자 또는 사업자단체의 업무 부담을 최소화할 수 있는 범위에서 조사기간을 연장할 수 있다.

③ 제2항 단서에 따라 조사기간을 연장하는 경우에는 해당 사업자 또는 사업자단체에 연장된 조사기간이 명시된 공문서를 발급하여야 한다.
