민사소송법 제313조(수명법관ㆍ수탁판사에 의한 증인신문)
Civil Procedure Act, Article 313 (Examination of Witnesses by Commissioned Judges or Entrusted Judges)
법원은 다음 각호 가운데 어느 하나에 해당하면 수명법관 또는 수탁판사로 하여금 증인을 신문하게 할 수 있다.
The court may have a commissioned judge or an entrusted judge examine a witness in any of the following cases:
1. 증인이 정당한 사유로 수소법원에 출석하지 못하는 때
1. Where the witness cannot appear before the court in which the lawsuit is pending for justifiable reasons;
2. 증인이 수소법원에 출석하려면 지나치게 많은 비용 또는 시간을 필요로 하는 때
2. Where it would require excessive cost or time for the witness to appear before the court in which the lawsuit is pending;
3. 그 밖의 상당한 이유가 있는 경우로서 당사자가 이의를 제기하지 아니하는 때
3. Where there is any other reasonable ground and the parties do not object.
