민사소송법 제465조(신청의 각하)

①지급명령의 신청이 제462조 본문 또는 제463조의 규정에 어긋나거나, 신청의 취지로 보아 청구에 정당한 이유가 없는 것이 명백한 때에는 그 신청을 각하하여야 한다. 청구의 일부에 대하여 지급명령을 할 수 없는 때에 그 일부에 대하여도 또한 같다.
