민사집행법 제238조(추심의 소제기)

채권자가 명령의 취지에 따라 제3채무자를 상대로 소를 제기할 때에는 일반규정에 의한 관할법원에 제기하고 채무자에게 그 소를 고지하여야 한다. 다만, 채무자가 외국에 있거나 있는 곳이 분명하지 아니한 때에는 고지할 필요가 없다.
