민사집행법 제42조(집행관에 의한 영수증의 작성ㆍ교부)

①채권자가 집행관에게 집행력 있는 정본을 교부하고 강제집행을 위임한 때에는 집행관은 특별한 권한을 받지 못하였더라도 지급이나 그 밖의 이행을 받고 그에 대한 영수증서를 작성하고 교부할 수 있다. 집행관은 채무자가 그 의무를 완전히 이행한 때에는 집행력 있는 정본을 채무자에게 교부하여야 한다.

②채무자가 그 의무의 일부를 이행한 때에는 집행관은 집행력 있는 정본에 그 사유를 덧붙여 적고 영수증서를 채무자에게 교부하여야 한다.

③채무자의 채권자에 대한 영수증 청구는 제2항의 규정에 의하여 영향을 받지 아니한다.
