민사집행법 제85조(현황조사)

①법원은 경매개시결정을 한 뒤에 바로 집행관에게 부동산의 현상, 점유관계, 차임(借賃) 또는 보증금의 액수, 그 밖의 현황에 관하여 조사하도록 명하여야 한다.

②집행관이 제1항의 규정에 따라 부동산을 조사할 때에는 그 부동산에 대하여 제82조에 규정된 조치를 할 수 있다.
