민사집행법 제87조(압류의 경합)

①강제경매절차 또는 담보권 실행을 위한 경매절차를 개시하는 결정을 한 부동산에 대하여 다른 강제경매의 신청이 있는 때에는 법원은 다시 경매개시결정을 하고, 먼저 경매개시결정을 한 집행절차에 따라 경매한다.

②먼저 경매개시결정을 한 경매신청이 취하되거나 그 절차가 취소된 때에는 법원은 제91조제1항의 규정에 어긋나지 아니하는 한도 안에서 뒤의 경매개시결정에 따라 절차를 계속 진행하여야 한다.

③제2항의 경우에 뒤의 경매개시결정이 배당요구의 종기 이후의 신청에 의한 것인 때에는 집행법원은 새로이 배당요구를 할 수 있는 종기를 정하여야 한다. 이 경우 이미 제84조제2항 또는 제4항의 규정에 따라 배당요구 또는 채권신고를 한 사람에 대하여는 같은 항의 고지 또는 최고를 하지 아니한다.

④먼저 경매개시결정을 한 경매절차가 정지된 때에는 법원은 신청에 따라 결정으로 뒤의 경매개시결정(배당요구의 종기까지 행하여진 신청에 의한 것에 한한다)에 기초하여 절차를 계속하여 진행할 수 있다. 다만, 먼저 경매개시결정을 한 경매절차가 취소되는 경우 제105조제1항제3호의 기재사항이 바뀔 때에는 그러하지 아니하다.
