방문판매 등에 관한 법률 제17조(청약철회등)

Door-to-Door Sales, etc. Act, Article 17 (Withdrawal of Offer, etc.)

① 다단계판매의 방법으로 재화등의 구매에 관한 계약을 체결한 소비자가 청약철회등을 하는 경우에는 제8조를 준용하며, 이 경우 "방문판매자등"은 "다단계판매자"로 본다. 다만, 소비자가 다단계판매원과 재화등의 구매에 관한 계약을 체결한 경우 그 소비자는 다단계판매원에 대하여 우선적으로 청약철회등을 하고, 다단계판매원의 소재 불명 등 대통령령으로 정하는 사유로 다단계판매원에 대하여 청약철회등을 하는 것이 어려운 경우에만 그 재화등을 공급한 다단계판매업자에 대하여 청약철회등을 할 수 있다.

② 다단계판매의 방법으로 재화등의 구매에 관한 계약을 체결한 다단계판매원은 다음 각 호의 어느 하나에 해당하는 경우를 제외하고는 계약을 체결한 날부터 3개월 이내에 서면(전자문서를 포함한다)으로 그 계약에 관한 청약철회등을 할 수 있다. <개정 2016.3.29>
