방문판매 등에 관한 법률 제38조(공제조합의 설립)

① 제5조제1항에 따라 신고하거나 제13조제1항 또는 제29조제3항에 따라 등록한 사업자는 소비자피해보상에 대한 보상금 지급을 책임지는 보험사업 등 제37조제1항제3호에 따른 공제사업을 운영하기 위하여 공정거래위원회의 인가를 받아 공제조합(이하 "공제조합"이라 한다)을 설립할 수 있으며, 인가의 기준은 대통령령으로 정한다.

② 공제조합은 법인으로 하며, 주된 사무소의 소재지에서 설립등기를 함으로써 성립한다.

(2) A어 mutual뮤추얼 aid에이드 association어소우시에이션 shall섈 be비 a어 corporation,코퍼^r레이션 and앤드 shall섈 be비 formed^f폼드 by바이 registering^r레지스터^r링 its잇츠 establishment이스태블리시먼트 at앳 the^ð더 location로케이션 of어^v브 its잇츠 principal프^r린서플 office.오^f피스

③ 공제조합에 가입한 자는 공제사업의 수행에 필요한 출자금 등을 조합에 내야 한다.

④ 공제조합의 기본재산은 대통령령으로 정하는 바에 따라 가입한 자의 출자금 등으로 조성하되, 공제조합의 기본재산의 운영에 관한 사항은 공정거래위원회의 인가를 받아야 한다. 다만, 정부는 예산의 범위에서 출연(出捐)하거나 보조할 수 있다.

⑤ 공제조합의 가입자격, 임원에 관한 사항 및 출자금의 부담기준에 관한 사항은 정관으로 정한다.

(5) Matters매터즈 concerning컨서닝 the^ð더 qualifications콸러^f퍼케이션즈 for^f포 membership,멤버쉽 officers,오^f퍼서즈 and앤드 the^ð더 standards스탠더즈 for^f포 sharing셰^r링 investment인^v베스트먼트 money머니 of어^v브 a어 mutual뮤추얼 aid에이드 association어소우시에이션 shall섈 be비 prescribed프^r리스크^r라이브드 by바이 its잇츠 articles아터클즈 of어^v브 incorporation.인코퍼^r레이션

⑥ 공제조합의 설립인가 절차, 정관 기재 사항, 운영, 이사회의 구성 및 권한, 임원의 선임, 감독 등에 관하여 필요한 사항은 대통령령으로 정한다.

(6) Matters매터즈 necessary네서세^r리 for^f포 the^ð디 authorization오^θ써^r러제이션 procedure프^r러시저 for^f포 establishing이스태블리슁 a어 mutual뮤추얼 aid에이드 association,어소우시에이션 the^ð더 matters매터즈 to투 be비 stated스테이티드 in인 its잇츠 articles아터클즈 of어^v브 incorporation,인코퍼^r레이션 its잇츠 operation,아퍼^r레이션 the^ð더 composition캄퍼지션 and앤드 authority어^θ쏘^r러티 of어^v브 its잇츠 board보드 of어^v브 directors,더^r렉터즈 the^ð디 appointment어포인트먼트 of어^v브 officers,오^f퍼서즈 supervision,수퍼^v비전 and앤드 the^ð더 like라이크 shall섈 be비 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree.디크^r리

⑦ 공제조합이 제1항에 따른 공제사업을 하려는 경우에는 공제규정을 정하여 공정거래위원회의 인가를 받아야 한다. 공제규정을 변경하려는 경우에도 또한 같다.

⑧ 제7항의 공제규정에는 공제사업의 범위, 공제료, 공제사업에 충당하기 위한 책임준비금 등 공제사업의 운영에 필요한 사항을 정하여야 한다.

⑨ 공제조합에 관하여 이 법에 규정된 것을 제외하고는 「민법」 중 사단법인에 관한 규정을 준용한다.

⑩ 이 법에 따른 공제조합의 사업에 대하여는 「보험업법」을 적용하지 아니한다.

(10) The^ð디 Insurance인슈^r런스 Business비즈니스 Act액트 shall섈 not낫 apply어플라이 to투 the^ð더 business비즈니스 of어^v브 a어 mutual뮤추얼 aid에이드 association어소우시에이션 under언더 this^ð디스 Act.액트
