병역법 시행령 제131조(가족의 범위 등)

1. 법 제62조제1항제1호에 따른 가족의 범위는 부모, 배우자, 직계비속 및 미혼의 형제자매(생모, 부모의 직계존속, 배우자의 직계존속, 기혼의 형제자매나 그의 배우자 또는 직계비속 등 사실상 생계를 같이하고 있는 사람을 포함한다)로 한다. 이 경우 생계를 같이하는지 여부의 판단기준은 병무청장이 정한다.

2. 법 제65조제2항 및 제65조의2제2항에 따른 가족의 범위는 가족관계등록부에 기록된 부모(양부모를 포함한다), 배우자 및 직계비속으로 한다. 다만, 다음 각 목의 어느 하나에 해당하는 사람은 가족에서 제외한다.
