병역법 시행령 제40조의8(복무기간의 만료 등)

① 해운업체등의 장은 소속 승선근무예비역으로서 복무기간이 만료되는 사람의 명단과 복무기록표를 복무기간이 만료되는 달의 전(前) 달 10일까지 관할 지방병무청장에게 송부하여야 한다.

② 관할 지방병무청장은 승선근무예비역이 복무기간을 마치게 되면 복무기간이 만료되는 달의 1일에 복무만료일을 명시하여 복무만료 처분을 하고, 그 내용을 지방병무청장과 승선근무예비역이 근무 중인 해운업체등의 장에게 알려야 한다. 이 경우 그 처분 내용을 기재하여 정리한 병역증을 해운업체등의 장을 거쳐 본인에게 전달하여야 한다.

③ 제2항에 따른 승선근무예비역 복무만료 처분의 대상인 사람은 복무기간이 만료된 날에 소집이 해제된 것으로 본다.
