부정경쟁방지 및 영업비밀보호에 관한 법률 시행령 제3조(의견청취의 절차)

① 지식재산처장, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 법 제9조에 따라 의견을 들으려는 경우에는 의견청취 예정일 10일 전까지 시정권고, 시정명령 및 공표의 상대방, 이해관계인, 참고인 또는 그 대리인에게 서면으로 그 뜻을 통지하여 의견을 진술할 기회를 주어야 한다. <개정 2011.9.22, 2021.4.20, 2024.8.13, 2025.10.1>

② 제1항에 따른 통지를 받은 시정권고, 시정명령 및 공표의 상대방, 이해관계인, 참고인 또는 그 대리인은 지정된 일시에 지정된 장소로 출석하여 의견을 진술하거나 서면으로 의견을 제출할 수 있다. <개정 2021.4.20, 2024.8.13>

③ 제2항에 따라 시정권고, 시정명령 및 공표의 상대방, 이해관계인, 참고인 또는 그 대리인이 출석하여 의견을 진술했을 때에는 관계 공무원은 그 요지를 서면으로 작성한 후 의견 진술자에게 그 내용을 확인하고 서명 또는 날인하게 해야 한다. <개정 2021.4.20, 2024.8.13>

④ 제1항에 따른 통지에는 정당한 사유 없이 이에 따르지 아니하면 의견을 진술할 기회를 포기한 것으로 본다는 뜻을 분명히 밝혀야 한다.
