사회보장기본법 제11조(사회보장급여의 신청)

① 사회보장급여를 받으려는 사람은 관계 법령에서 정하는 바에 따라 국가나 지방자치단체에 신청하여야 한다. 다만, 관계 법령에서 따로 정하는 경우에는 국가나 지방자치단체가 신청을 대신할 수 있다.

② 사회보장급여를 신청하는 사람이 다른 기관에 신청한 경우에는 그 기관은 지체 없이 이를 정당한 권한이 있는 기관에 이송하여야 한다. 이 경우 정당한 권한이 있는 기관에 이송된 날을 사회보장급여의 신청일로 본다.
