상법 제723조(피보험자의 변제 등의 통지와 보험금액의 지급)

①피보험자가 제3자에 대하여 변제, 승인, 화해 또는 재판으로 인하여 채무가 확정된 때에는 지체없이 보험자에게 그 통지를 발송하여야 한다.

③피보험자가 보험자의 동의없이 제3자에 대하여 변제, 승인 또는 화해를 한 경우에는 보험자가 그 책임을 면하게 되는 합의가 있는 때에도 그 행위가 현저하게 부당한 것이 아니면 보험자는 보상할 책임을 면하지 못한다.
