상표법 제106조(상표권의 소멸)

① 상표권자가 사망한 날부터 3년 이내에 상속인이 그 상표권의 이전등록을 하지 아니한 경우에는 상표권자가 사망한 날부터 3년이 되는 날의 다음 날에 상표권이 소멸된다.

② 상표권의 상속이 개시된 때 상속인이 없는 경우에는 그 상표권은 소멸된다. <신설 2023.10.31>

③ 청산절차가 진행 중인 법인의 상표권은 법인의 청산종결등기일(청산종결등기가 되었더라도 청산사무가 사실상 끝나지 아니한 경우에는 청산사무가 사실상 끝난 날과 청산종결등기일부터 6개월이 지난 날 중 빠른 날로 한다. 이하 이 항에서 같다)까지 그 상표권의 이전등록을 하지 아니한 경우에는 청산종결등기일의 다음 날에 소멸된다. <개정 2023.10.31>
