성폭력범죄의 처벌 등에 관한 특례법 시행령 제2조의5(신분비공개수사의 승인 절차 등)

① 신분비공개수사를 하려는 사법경찰관리는 법 제22조의3에 따라 신분비공개수사 전(법 제22조의4에 따른 긴급 신분비공개수사의 경우에는 신분비공개수사 개시 후 48시간이 되기 전을 말한다)에 경찰청장 또는 해양경찰청장이 정하는 서면으로 바로 위 상급 경찰관서 수사부서의 장의 승인을 받아야 한다.

② 사법경찰관리는 제1항에 따른 승인을 받으려면 신분비공개수사의 필요성ㆍ대상ㆍ범위ㆍ기간ㆍ장소 및 방법 등을 바로 위 상급 경찰관서 수사부서의 장에게 소명해야 한다.

③ 사법경찰관리는 신분비공개수사를 종료한 때에는 종료 일시 및 종료 사유 등을 바로 위 상급 경찰관서 수사부서의 장에게 보고해야 한다.
