성폭력범죄의 처벌 등에 관한 특례법 제16조(형벌과 수강명령 등의 병과)

① 법원이 성폭력범죄를 범한 사람에 대하여 형의 선고를 유예하는 경우에는 1년 동안 보호관찰을 받을 것을 명할 수 있다. 다만, 성폭력범죄를 범한 「소년법」 제2조에 따른 소년에 대하여 형의 선고를 유예하는 경우에는 반드시 보호관찰을 명하여야 한다.

② 법원이 성폭력범죄를 범한 사람에 대하여 유죄판결(선고유예는 제외한다)을 선고하거나 약식명령을 고지하는 경우에는 500시간의 범위에서 재범예방에 필요한 수강명령 또는 성폭력 치료프로그램의 이수명령(이하 "이수명령"이라 한다)을 병과하여야 한다. 다만, 수강명령 또는 이수명령을 부과할 수 없는 특별한 사정이 있는 경우에는 그러하지 아니하다. <개정 2016.12.20>

(2) When웬 a어 court코트 pronounces프^r러나운시즈 a어 judgment저지먼트 of어^v브 conviction컨^v빅션 (excluding익스클루딩 a어 suspension서스펜션 of어^v브 sentence)센튼스 or오 issues이슈즈 a어 summary서머^r리 order오더 against어겐스트 a어 person퍼슨 who후 has해즈 committed커미티드 a어 sexual섹슈얼 crime,크^r라임 it잇 shall섈 concurrently컨커^r런틀리 impose,임포우즈 within위^ð딘 the^ð더 limit리밋 of어^v브 500 hours,아워즈 an앤 order오더 to투 attend어텐드 lectures렉처즈 necessary네서세^r리 to투 prevent프^r리^v벤트 re-offending^r레이-어^f펜딩 or오 an앤 order오더 to투 complete컴플릿 a어 sexual섹슈얼 violence^v바이얼런스 treatment트^r릿먼트 program프^r로우그^r램 (hereinafter히^r리내^f프터 referred^r러^f퍼드 to투 as애즈 "completion컴플리션 order").오더 However,하우에^v버 this^ð디스 shall섈 not낫 apply어플라이 where웨어 there^ð데어 are아 special스페실 circumstances서컴스탠시즈 in인 which위치 an앤 order오더 to투 attend어텐드 lectures렉처즈 or오 a어 completion컴플리션 order오더 cannot캐낫 be비 imposed.임포우즈드

③ 성폭력범죄를 범한 자에 대하여 제2항의 수강명령은 형의 집행을 유예할 경우에 그 집행유예기간 내에서 병과하고, 이수명령은 벌금 이상의 형을 선고하거나 약식명령을 고지할 경우에 병과한다. 다만, 이수명령은 성폭력범죄자가 「전자장치 부착 등에 관한 법률」 제9조의2제1항제4호에 따른 이수명령을 부과받은 경우에는 병과하지 아니한다. <개정 2016.12.20, 2020.2.4>

④ 법원이 성폭력범죄를 범한 사람에 대하여 형의 집행을 유예하는 경우에는 제2항에 따른 수강명령 외에 그 집행유예기간 내에서 보호관찰 또는 사회봉사 중 하나 이상의 처분을 병과할 수 있다.

(4) When웬 a어 court코트 suspends서스펜즈 the^ð디 execution엑서큐션 of어^v브 the^ð더 sentence센튼스 of어^v브 a어 person퍼슨 who후 has해즈 committed커미티드 a어 sexual섹슈얼 crime,크^r라임 it잇 may,메이 in인 addition어디션 to투 the^ð디 order오더 to투 attend어텐드 lectures렉처즈 under언더 paragraph패^r러그^r래^f프 (2), concurrently컨커^r런틀리 impose임포우즈 one원 or오 more모 dispositions디스퍼지션즈 of어^v브 probation프^r로베이션 or오 community커뮤너티 service서^v비스 within위^ð딘 the^ð더 period피^r리어드 of어^v브 the^ð더 suspended서스펜디드 execution.엑서큐션

⑤ 제2항에 따른 수강명령 또는 이수명령은 형의 집행을 유예할 경우에는 그 집행유예기간 내에, 벌금형을 선고하거나 약식명령을 고지할 경우에는 형 확정일부터 6개월 이내에, 징역형 이상의 실형(實刑)을 선고할 경우에는 형기 내에 각각 집행한다. 다만, 수강명령 또는 이수명령은 성폭력범죄를 범한 사람이 「아동ㆍ청소년의 성보호에 관한 법률」 제21조에 따른 수강명령 또는 이수명령을 부과받은 경우에는 병과하지 아니한다. <개정 2016.12.20>

⑥ 제2항에 따른 수강명령 또는 이수명령이 벌금형 또는 형의 집행유예와 병과된 경우에는 보호관찰소의 장이 집행하고, 징역형 이상의 실형(치료감호와 징역형 이상의 실형이 병과된 경우를 포함한다. 이하 이 항에서 같다)과 병과된 경우에는 교정시설의 장 또는 치료감호시설의 장(이하 "교정시설등의 장"이라 한다)이 집행한다. 다만, 징역형 이상의 실형과 병과된 이수명령을 모두 이행하기 전에 석방 또는 가석방되거나 미결구금일수 산입 등의 사유로 형을 집행할 수 없게 된 경우에는 보호관찰소의 장이 남은 이수명령을 집행한다. <개정 2024.1.16>

⑦ 제2항에 따른 수강명령 또는 이수명령은 다음 각 호의 내용으로 한다.

⑧ 성폭력범죄를 범한 사람으로서 형의 집행 중에 가석방된 사람은 가석방기간 동안 보호관찰을 받는다. 다만, 가석방을 허가한 행정관청이 보호관찰을 할 필요가 없다고 인정한 경우에는 그러하지 아니하다.

(8) A어 person퍼슨 who후 has해즈 committed커미티드 a어 sexual섹슈얼 crime크^r라임 and앤드 is이즈 released^r릴리스트 on안 parole퍼^r로울 while와일 serving서^v빙 a어 sentence센튼스 shall섈 be비 placed플레이스트 on안 probation프^r로베이션 during두^r링 the^ð더 period피^r리어드 of어^v브 parole.퍼^r로울 However,하우에^v버 this^ð디스 shall섈 not낫 apply어플라이 where웨어 the^ð디 administrative어드미너스트^r레이티^v브 agency에이전시 that^ð댓 granted그^r랜티드 the^ð더 parole퍼^r로울 finds^f파인즈 that^ð댓 probation프^r로베이션 is이즈 not낫 necessary.네서세^r리

⑨ 보호관찰, 사회봉사, 수강명령 및 이수명령에 관하여 이 법에서 규정한 사항 외의 사항에 대하여는 「보호관찰 등에 관한 법률」을 준용한다.
