식품위생법 제35조(소비자 위생점검 참여 등)

① 대통령령으로 정하는 영업자는 식품위생에 관한 전문적인 지식이 있는 자 또는 「소비자기본법」 제29조에 따라 등록한 소비자단체의 장이 추천한 자로서 식품의약품안전처장이 정하는 자에게 위생관리 상태를 점검받을 수 있다. <개정 2013.3.23>

② 제1항에 따른 점검 결과 식품의약품안전처장이 정하는 기준에 적합하여 합격한 경우 해당 영업자는 그 합격사실을 총리령으로 정하는 바에 따라 해당 영업소에서 제조ㆍ가공한 식품등에 표시하거나 광고할 수 있다. <개정 2010.1.18, 2013.3.23>

③ 식품의약품안전처장(대통령령으로 정하는 그 소속 기관의 장을 포함한다. 이하 이 조에서 같다), 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제1항에 따라 위생점검을 받은 영업소 중 식품의약품안전처장이 정하는 기준에 따른 우수 등급의 영업소에 대하여는 관계 공무원으로 하여금 총리령으로 정하는 일정 기간 동안 제22조에 따른 출입ㆍ검사ㆍ수거 등을 하지 아니하게 할 수 있다. <개정 2010.1.18, 2013.3.23, 2016.2.3>
