식품위생법 제39조(영업 승계)

① 영업자가 영업을 양도하거나 사망한 경우 또는 법인이 합병한 경우에는 그 양수인ㆍ상속인 또는 합병 후 존속하는 법인이나 합병에 따라 설립되는 법인은 그 영업자의 지위를 승계한다.

② 다음 각 호의 어느 하나에 해당하는 절차에 따라 영업 시설의 전부를 인수한 자는 그 영업자의 지위를 승계한다. 이 경우 종전의 영업자에 대한 영업 허가ㆍ등록 또는 그가 한 신고는 그 효력을 잃는다. <개정 2011.6.7, 2016.2.3, 2016.12.27>

③ 제1항 또는 제2항에 따라 그 영업자의 지위를 승계한 자는 총리령으로 정하는 바에 따라 1개월 이내에 그 사실을 식품의약품안전처장 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장에게 신고하여야 한다. <개정 2010.1.18, 2013.3.23, 2016.2.3>

④ 식품의약품안전처장 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제3항에 따른 신고를 받은 날부터 3일 이내에 신고수리 여부를 신고인에게 통지하여야 한다. <신설 2018.12.11>

⑤ 식품의약품안전처장 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장이 제4항에서 정한 기간 내에 신고수리 여부 또는 민원 처리 관련 법령에 따른 처리기간의 연장을 신고인에게 통지하지 아니하면 그 기간(민원 처리 관련 법령에 따라 처리기간이 연장 또는 재연장된 경우에는 해당 처리기간을 말한다)이 끝난 날의 다음 날에 신고를 수리한 것으로 본다. <신설 2018.12.11>

⑥ 제1항 및 제2항에 따른 승계에 관하여는 제38조를 준용한다. 다만, 상속인이 제38조제1항제8호에 해당하면 상속받은 날부터 3개월 동안은 그러하지 아니하다. <개정 2018.12.11>
