실용신안법 제23조(실용신안권의 효력)

실용신안권자는 업(業)으로서 등록실용신안을 실시할 권리를 독점한다. 다만, 그 실용신안권에 관하여 제28조에 따라 준용되는 「특허법」 제100조제1항에 따라 전용실시권을 설정하였을 때에는 같은 조 제2항에 따라 전용실시권자가 그 등록실용신안을 실시할 권리를 독점하는 범위에서는 그러하지 아니하다.
