실용신안법 제8조의2(실용신안등록출원일 등)

① 실용신안등록출원일은 명세서 및 도면을 첨부한 실용신안등록출원서가 지식재산처장에게 도달한 날로 한다. 이 경우 명세서에 청구범위는 적지 아니할 수 있으나, 고안의 설명은 적어야 한다. <개정 2025.10.1>

② 실용신안등록출원인은 제1항 후단에 따라 실용신안등록출원서에 최초로 첨부한 명세서에 청구범위를 적지 아니한 경우에는 제15조에 따라 준용되는 「특허법」 제64조제1항 각 호의 구분에 따른 날부터 1년 2개월이 되는 날까지 명세서에 청구범위를 적는 보정을 하여야 한다. 다만, 본문에 따른 기한 이전에 제15조에 따라 준용되는 「특허법」 제60조제3항에 따른 출원심사 청구의 취지를 통지받은 경우에는 그 통지를 받은 날부터 3개월이 되는 날 또는 제15조에 따라 준용되는 「특허법」 제64조제1항 각 호의 구분에 따른 날부터 1년 2개월이 되는 날 중 빠른 날까지 보정을 하여야 한다.

③ 실용신안등록출원인이 제2항에 따른 보정을 하지 아니한 경우에는 제2항에 따른 기한이 되는 날의 다음 날에 해당 실용신안등록출원을 취하한 것으로 본다.

(3) Where웨어 the^ð디 applicant애플리컨트 fails^f페일즈 to투 make메이크 the^ð디 amendment어멘드먼트 under언더 paragraph패^r러그^r래^f프 (2), the^ð디 application애플러케이션 for^f포 utility유틸러티 model마들 registration^r레지스트^r레이션 shall섈 be비 deemed딤드 withdrawn위^θ스드^r론 on안 the^ð더 day데이 following^f팔로잉 the^ð더 deadline데들라인 under언더 paragraph패^r러그^r래^f프 (2).
