아동복지법 시행령 제26조의4(피해아동의 취학에 대한 지원)

① 법 제29조제6항에 따라 국가와 지방자치단체의 장은 교육감, 교육장 또는 「초ㆍ중등교육법」 제2조에 따른 학교의 장에게 「초ㆍ중등교육법」 제2조 각 호의 학교에 재학 중인 피해아동 및 그 가족이 주소지 외의 지역에서 취학(입학ㆍ재입학ㆍ전학ㆍ편입학을 포함한다. 이하 같다)을 할 필요가 있을 때에는 그 취학에 필요한 조치를 요청할 수 있다. <개정 2022.6.21>

② 제1항 및 법 제29조제7항 전단에 따라 요청을 받은 교육감, 교육장 또는 「초ㆍ중등교육법」 제2조에 따른 학교의 장은 피해아동 및 피해아동의 가족이 보호받고 있는 거주지 근처의 학교에 우선적으로 취학할 수 있도록 고려해야 한다. <개정 2026.8.4>

③ 「초ㆍ중등교육법」 제2조에 따른 학교의 장은 피해아동 및 그 가족의 취학에 필요한 절차가 완료되기 전이라도 피해아동 및 그 가족이 출석하여 학습하게 할 수 있다.

④ 교육감, 교육장 또는 「초ㆍ중등교육법」 제2조에 따른 학교의 장은 제1항부터 제3항까지의 규정에 따라 조치한 사실이 취학업무 관계자가 아닌 자에게 공개되지 않도록 관리ㆍ감독해야 하며, 아동학대행위자 및 아동학대사례관리대상자로부터 피해아동 및 피해아동의 가족의 취학에 관한 정보의 제공 요청이 있는 경우에는 그 사실을 피해아동 및 피해아동의 가족을 보호하는 아동보호전문기관에 통보해야 한다. <개정 2026.8.4>
