아동학대범죄의 처벌 등에 관한 특례법 제40조(보호처분의 변경)

① 법원은 보호처분이 진행되는 동안 필요하다고 인정하는 경우에는 직권 또는 검사, 시ㆍ도지사, 시장ㆍ군수ㆍ구청장, 보호관찰관 또는 수탁기관의 장의 청구에 의하여 결정으로 보호처분의 종류와 기간을 변경할 수 있다. <개정 2020.3.24>

② 법원은 필요한 경우 제38조제1항에 따른 집행담당자로 하여금 집행상황을 보고하도록 할 수 있으며, 가정보호사건조사관으로 하여금 보호처분에 관한 집행상황에 대하여 조사하도록 할 수 있다. <신설 2020.3.24>

③ 제1항에 따라 보호처분의 종류와 기간을 변경하는 경우 종전의 처분기간을 합산하여 제36조제1항제1호부터 제3호까지 및 제5호부터 제8호까지의 규정에 따른 보호처분의 기간은 2년을, 같은 항 제4호의 규정에 따른 사회봉사ㆍ수강명령의 시간은 400시간을 각각 초과할 수 없다. <개정 2020.3.24>

④ 법원은 제1항에 따라 처분변경 결정을 한 경우에는 지체 없이 그 사실을 검사, 아동학대행위자, 피해아동, 법정대리인, 변호사, 보조인, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장, 보호관찰관 및 수탁기관의 장에게 통지하여야 한다. <개정 2020.3.24>
