① 방송미디어통신위원회는 다음 각 호의 어느 하나에 해당하는 경우에는 위치정보사업자등에게 관계 물품ㆍ서류 등 필요한 자료의 제출을 요구할 수 있다. <개정 2025.10.1>

1. 이 법에 위반되는 사항을 발견하거나 혐의가 있음을 알게 된 경우

② 방송미디어통신위원회는 위치정보사업자등이 제1항에 따른 자료를 제출하지 아니하거나 이 법을 위반한 사실이 있다고 인정되면 소속 공무원으로 하여금 위치정보사업자등의 사업장 등에 출입하여 업무상황, 관계 물품ㆍ서류 및 시설ㆍ장비 등을 검사하게 할 수 있다. 이 경우 제16조제4항을 준용한다. <개정 2025.10.1>

③ 방송미디어통신위원회는 제5조에 따른 개인위치정보를 대상으로 하는 위치정보사업의 등록 등의 사항에 대하여 대통령령으로 정하는 바에 따라 연 1회 이상 정기적으로 실태를 점검하여야 한다. 이 경우 개인위치정보사업자에게 관계 물품ㆍ서류 등 필요한 자료의 제출을 요구할 수 있다. <신설 2021.10.19, 2025.10.1>
