위치정보의 보호 및 이용 등에 관한 법률 제8조(위치정보사업의 휴업ㆍ폐업 등)

① 위치정보사업자가 위치정보사업의 전부 또는 일부를 휴업하려는 경우에는 개인위치정보주체에 대한 휴업기간 및 휴업 사실의 통보계획을 정하여(개인위치정보사업자만 해당한다) 다음 각 호의 구분에 따라 방송미디어통신위원회의 승인을 받거나 방송미디어통신위원회에 신고하여야 한다. 이 경우 휴업기간은 1년을 초과할 수 없다. <개정 2025.10.1>

② 위치정보사업자가 위치정보사업의 전부 또는 일부를 폐업하려는 경우에는 개인위치정보주체에 대한 폐업 사실의 통보계획을 정하여(개인위치정보사업자만 해당한다) 다음 각 호의 구분에 따라 방송미디어통신위원회의 승인을 받거나 방송미디어통신위원회에 신고하여야 한다. <개정 2025.10.1>

③ 제1항제1호 또는 제2항제1호에 따른 승인을 받은 개인위치정보사업자는 휴업하려는 날 또는 폐업하려는 날의 30일 전까지 다음 각 호의 구분에 따른 사항을 개인위치정보주체에게 통보하여야 한다.

④ 제1항제1호에 따른 승인을 받아 위치정보사업의 전부 또는 일부를 휴업하는 개인위치정보사업자와 제2항에 따라 위치정보사업의 전부 또는 일부를 폐업하는 위치정보사업자는 휴업 또는 폐업과 동시에 다음 각 호의 구분에 따라 개인위치정보 및 위치정보 수집사실 확인자료를 파기하여야 한다.

⑤ 방송미디어통신위원회는 제1항제1호 또는 제2항제1호에 따른 승인 신청을 받은 경우 개인위치정보주체에 대한 휴업ㆍ폐업 사실의 통보계획이 적정하지 못한 경우를 제외하고는 승인하여야 한다. <개정 2025.10.1>

⑥ 방송미디어통신위원회는 제1항제2호 또는 제2항제2호에 따른 신고를 받은 경우 그 내용을 검토하여 이 법에 적합하면 신고를 수리하여야 한다. <개정 2025.10.1>

⑦ 제1항부터 제6항까지에서 규정한 사항 외에 위치정보사업의 휴업 및 폐업에 필요한 사항은 대통령령으로 정한다.
