①유치원을 설립하려는 자는 시설ㆍ설비 등 대통령령으로 정하는 설립기준을 갖추어야 한다. <개정 2010.3.24>

④사립유치원을 설립ㆍ경영하는 자가 유치원을 폐쇄하려는 경우나 대통령령으로 정하는 중요사항을 변경하려는 경우에는 교육감의 인가를 받아야 한다. 다만, 유치원을 폐쇄하려는 경우에는 인가 신청 전에 다음 각 호의 사항을 보호자에게 통지하여야 한다. <개정 2010.3.24, 2012.3.21, 2025.11.11>
