Emergency Medical Service Act, Article 35 (Revocation of Designation of Emergency Medical Institutions)

① 응급의료기관 및 권역외상센터, 지역외상센터가 다음 각 호의 어느 하나에 해당하는 경우에는 보건복지부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장 중 해당 지정권자가 그 지정을 취소할 수 있다. <개정 2012.5.14, 2016.12.2>

(1) Where웨어 an앤 emergency이머전시 medical메더클 institution,인스티투션 a어 regional^r리저늘 trauma트^r로마 center,센터 or오 a어 local로우클 trauma트^r로마 center센터 falls^f폴즈 under언더 any에니 of어^v브 the^ð더 following,^f팔로잉 whichever위체^v버 of어^v브 the^ð더 Minister미너스터 of어^v브 Health헬^θ스 and앤드 Welfare,웰^f페어 the^ð더 Mayor/Do메이어 Governor,거^v버너 or오 the^ð더 head헤드 of어^v브 the^ð더 Si/Gun/Gu시 designated데지그네이티드 it잇 may메이 revoke^r리^v보우크 its잇츠 designation:데저그네이션

1. 지정기준에 미달한 경우

1. Where웨어 it잇 falls^f폴즈 short쇼트 of어^v브 the^ð더 designation데저그네이션 standards;스탠더즈

2. 이 법에 따른 업무를 수행하지 아니한 경우

2. Where웨어 it잇 fails^f페일즈 to투 perform퍼^f폼 the^ð더 duties두티즈 under언더 this^ð디스 Act;액트

3. 이 법 또는 이 법에 따른 처분이나 명령을 위반한 경우

② 보건복지부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 응급의료기관 및 권역외상센터, 지역외상센터가 제1항 각 호의 어느 하나에 해당하는 경우에는 일정한 기간을 정하여 위반한 사항을 시정하도록 명하여야 한다. <신설 2016.12.2>

(2) Where웨어 an앤 emergency이머전시 medical메더클 institution,인스티투션 a어 regional^r리저늘 trauma트^r로마 center,센터 or오 a어 local로우클 trauma트^r로마 center센터 falls^f폴즈 under언더 any에니 subparagraph서브패^r러그^r래^f프 of어^v브 paragraph패^r러그^r래^f프 (1), the^ð더 Minister미너스터 of어^v브 Health헬^θ스 and앤드 Welfare,웰^f페어 the^ð더 Mayor/Do메이어 Governor,거^v버너 or오 the^ð더 head헤드 of어^v브 the^ð더 Si/Gun/Gu시 shall섈 order오더 it잇 to투 correct커^r렉트 the^ð더 violation^v바이얼레이션 within위^ð딘 a어 set셋 period.피^r리어드

③ 보건복지부장관, 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제2항의 시정명령을 한 경우 명령의 성실한 이행을 위하여 명령이 이행될 때까지 제16조제1항, 제17조제4항 및 제30조의4에 따른 재정 지원의 전부 또는 일부를 중단할 수 있다. <신설 2016.12.2>

④ 보건복지부장관은 응급의료기관 및 권역외상센터, 지역외상센터가 제2항에 따른 시정명령을 이행하지 아니한 경우 일정한 기간을 정하여 제23조에 따른 응급의료수가를 차감할 수 있다. <신설 2016.12.2>
