의료급여법 시행령 제18조의2(포상금의 지급 등)

① 법 제32조의3제1항 각 호의 어느 하나에 해당하는 자를 신고하려는 사람은 보건복지부장관이 정하는 바에 따라 시장ㆍ군수 구청장에게 신고해야 한다. 이 경우 2명 이상이 공동명의로 신고할 때에는 대표자를 지정해야 한다. <개정 2023.9.12>

② 시장ㆍ군수ㆍ구청장은 제1항에 따라 신고를 받으면 그 내용을 확인한 후 포상금 지급 여부를 결정하여 신고인(2명 이상이 공동명의로 신고한 경우에는 제1항 후단에 따른 대표자를 말한다. 이하 이 조에서 같다)에게 통보하여야 한다.

③ 신고인은 제2항에 따라 포상금 지급 결정을 통보받으면 보건복지부장관이 정하는 바에 따라 시장ㆍ군수ㆍ구청장에게 포상금 지급을 신청하여야 한다.

④ 시장ㆍ군수ㆍ구청장은 제3항에 따라 포상금 지급 신청을 받은 날부터 1개월 이내에 신고인에게 별표 4의 포상금 지급 기준에 따른 포상금을 지급하여야 한다.

⑤ 제1항에 따른 신고를 받은 후에 신고된 내용과 같은 내용의 신고를 한 사람에게는 포상금을 지급하지 아니한다.

⑥ 제1항부터 제5항까지에서 규정한 사항 외에 포상금의 지급 기준과 방법ㆍ절차 등에 관한 사항은 보건복지부장관이 정하여 고시한다.
