의료급여법 제11조의3(급여 대상 여부의 확인 등)

① 수급권자는 본인부담금 외에 부담한 비용이 제7조제3항에 따라 의료급여의 대상에서 제외되는 사항에 해당하는 비용(이하 "비급여비용"이라 한다)인지에 대하여 급여비용심사기관에 확인을 요청할 수 있다.

② 제1항에 따라 확인을 요청받은 급여비용심사기관은 그 확인결과를 확인을 요청한 수급권자에게 알려야 하며, 확인을 요청한 비용이 급여비용에 해당하는 것으로 확인되었을 때에는 급여비용지급기관 및 관련 의료급여기관에도 각각 알려야 한다.

③ 제2항에 따라 통보받은 의료급여기관은 과다 징수한 금액을 지체 없이 수급권자에게 반환하여야 한다.

④ 급여비용지급기관은 제3항에도 불구하고 의료급여기관이 과다 징수한 금액을 반환하지 아니하면 그 의료급여기관에 지급할 급여비용에서 과다 징수한 금액을 공제하여 그 공제한 금액을 수급권자에게 지급할 수 있다.

⑤ 제1항부터 제4항까지에 따른 확인 요청의 범위, 방법, 절차, 처리기간 등 필요한 사항은 보건복지부령으로 정한다. <신설 2023.3.28>
