자동차관리법 제51조의5(이륜자동차검사 기술인력의 직무 등)

Motor Vehicle Management Act, Article 51-5 (Duties, etc. of Technical Personnel for Two-Wheeled Motor Vehicle Inspections)

① 이륜자동차검사대행자 및 이륜자동차지정정비사업자가 갖추어야 할 기술인력의 구분 및 직무 등에 관하여 필요한 사항은 공동부령으로 정한다.

② 국토교통부장관은 제1항에 따른 기술인력이 다음 각 호의 어느 하나에 해당하는 경우에는 해당 이륜자동차검사대행자 및 이륜자동차지정정비사업자에게 공동부령으로 정하는 바에 따라 그 해임을 명하거나 일정기간 그 직무를 정지하게 할 수 있다.

1. 업무와 관련하여 부정한 금품을 수수하거나 그 밖의 부정한 행위를 한 경우

3. 제52조에서 준용하는 제46조의2제1항을 위반하여 정당한 사유 없이 이륜자동차검사에 관한 교육을 받지 아니한 경우

③ 제2항에 따라 해임처분을 받은 기술인력은 그 해임처분을 받은 날부터 1년이 지나지 아니하고는 제1항에 따른 기술인력으로 선임될 수 없다.

④ 국토교통부장관은 제2항에 따라 해임 또는 직무 정지 등의 처분을 받은 기술인력의 현황을 제69조에 따른 전산정보처리조직으로 하여금 관리하도록 한다.

⑤ 제2항 및 제4항에 따른 명령의 세부 기준과 절차, 관리방법, 그 밖에 필요한 사항은 공동부령으로 정한다.
