자동차관리법 제68조의24(조사 및 검사 등)

① 국토교통부장관은 공제조합의 재무건전성 유지, 자동차 매수인 등의 권익 보호 등을 위하여 필요하다고 인정하면 공제조합에 대하여 그 업무에 관한 사항을 보고하게 하거나 자료의 제출을 명할 수 있으며, 소속 공무원으로 하여금 공제조합의 업무 상황 또는 회계 상황을 조사하게 하거나 장부 또는 그 밖의 서류를 검사하게 할 수 있다.

② 국토교통부장관은 제1항에 따른 조사나 검사를 하려면 조사 또는 검사 7일 전에 조사 또는 검사할 내용, 일시, 이유 등 조사 또는 검사 계획을 미리 공제조합에 알려야 한다. 다만, 긴급한 경우 또는 사전통지를 하면 증거인멸 등으로 조사목적을 달성할 수 없다고 인정하는 경우에는 그러하지 아니하다.

③ 제1항에 따라 조사 또는 검사를 하는 공무원은 그 권한을 표시하는 증표를 지니고 관계인에게 보여주어야 한다.

④ 국토교통부장관은 공제사업에 관하여 「금융위원회의 설치 등에 관한 법률」에 따른 금융감독원의 원장에게 조사 또는 검사를 요청할 수 있다.

⑤ 국토교통부장관은 제68조의17제1항제1호부터 제3호까지의 보증사업 및 공제사업의 건전한 육성과 계약자 보호를 위하여 금융위원회 위원장과 협의하여 감독에 필요한 기준을 정하여 고시하여야 한다.
