① 법 제165조의7제1항 각 호 외의 부분 본문에서 "대통령령으로 정하는 주권상장법인"이란 한국거래소가 법 제4조제2항 각 호의 증권의 매매를 위하여 개설한 증권시장으로서 금융위원회가 정하여 고시하는 증권시장(이하 "유가증권시장"이라 한다)에 주권이 상장된 법인을 말한다. <신설 2013.8.27>

④ 법 제165조의7제2항에 따른 우리사주조합원의 소유주식수는 법 제119조제1항에 따라 증권의 모집 또는 매출에 관한 신고서를 금융위원회에 제출한 날(법 제119조제2항 전단에 따른 일괄신고서를 제출하여 증권의 모집 또는 매출에 관한 신고서를 제출하지 아니하는 경우에는 주주총회 또는 이사회의 결의가 있은 날)의 직전일의 주주명부상 우리사주조합의 대표자 명의로 명의개서된 주식에 따라 산정한다. 다만, 「근로복지기본법」 제43조제1항에 따른 수탁기관(이하 이 항에서 "수탁기관"이라 한다)을 통해서 전자등록(「주식ㆍ사채 등의 전자등록에 관한 법률」 제2조제2호에 따른 전자등록을 말한다. 이하 같다)된 주식의 경우에는 같은 법 제22조제2항에 따른 고객계좌부에 따라 산정하고, 수탁기관이 예탁결제원에 예탁한 주식의 경우에는 법 제310조제1항에 따른 투자자계좌부에 따라 산정한다. <개정 2010.12.7, 2013.8.27, 2019.6.25>
