Enforcement Decree of the Financial Investment Services and Capital Markets Act, Article 186-3 (Obligation to Clear Over-the-Counter Transactions)

① 법 제166조의3에서 "대통령령으로 정하는 자"란 외국 금융투자업자를 말한다.

② 법 제166조의3에서 "대통령령으로 정하는 장외파생상품의 매매 및 그 밖의 장외거래"란 원화로 표시된 원본액에 대하여 일정한 기간 동안 고정이자와 변동이자를 장래의 특정 시점마다 원화로 교환할 것을 약정하는 거래로서 기초자산, 거래의 만기 등에 관하여 금융위원회가 정하여 고시하는 요건을 충족하는 장외파생상품거래를 말한다. 다만, 법 또는 법에 상응하는 외국의 법령 등에 따라 금융투자상품거래청산회사(법 제323조의3에 따라 금융투자상품거래청산업의 인가를 받은 자를 말한다. 이하 같다)를 통한 청산이 불가능한 경우로서 금융위원회가 정하여 고시하는 거래는 제외한다.

③ 법 제166조의3에서 "그 밖에 이에 준하는 자로서 대통령령으로 정하는 자"란 외국 법령에 따라 외국에서 금융투자상품거래청산업에 상당하는 업무를 하는 자(이하 "외국금융투자상품거래청산회사"라 한다)로서 다음 각 호의 요건을 모두 충족하는 자 중에서 금융위원회가 승인하는 자를 말한다.
