자본시장과 금융투자업에 관한 법률 시행령 제205조(시장조성의 방법 등)

① 제203조에 따른 투자매매업자는 법 제176조제3항제2호에 따라 시장조성을 하려는 경우에는 다음 각 호의 사항을 기재한 시장조성신고서를 미리 금융위원회와 거래소에 제출하여야 한다.

② 제203조에 따른 투자매매업자는 시장조성의 대상이 되는 증권의 모집 또는 매출가격을 초과하여 매수하거나 모집 또는 매출가격을 밑도는 가격으로 매도하여서는 아니 된다. 다만, 권리락ㆍ배당락 또는 이자락이 발생한 경우에는 이를 고려하여 계산한 가격을 기준으로 한다.

③ 시장조성에 관하여서는 제204조제1항ㆍ제2항ㆍ제5항 및 제6항을 준용한다. 이 경우 "안정조작"은 "시장조성"으로 본다.

④ 법 제176조제3항제2호에서 "대통령령으로 정하는 기간"이란 모집되거나 매출되는 증권이 상장된 날부터 1개월 이상 6개월 이하의 범위에서 인수계약으로 정하는 날까지의 기간을 말한다.

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 시장조성신고서ㆍ시장조성보고서의 서식과 작성방법 등에 관하여 필요한 사항은 금융위원회가 정하여 고시한다.
