자본시장과 금융투자업에 관한 법률 제323조의15(채무변제순위)

① 청산대상업자가 청산대상거래에 따른 채무를 이행하지 아니하여 금융투자상품거래청산회사 또는 다른 청산대상업자에게 손해를 끼친 경우 그 손해를 입은 금융투자상품거래청산회사 또는 다른 청산대상업자는 그 손해를 끼친 청산대상업자의 청산증거금 및 손해배상공동기금 지분에 대하여 다른 채권자보다 우선하여 변제받을 권리를 가진다.

② 금융투자상품거래청산회사는 청산대상업자가 결제를 위하여 납부한 결제목적물 및 결제대금에 관하여 다른 채권자보다 우선하여 변제를 받을 권리가 있다.

③ 금융투자상품거래청산회사는 청산대상거래에 따른 결제의 완료 전에 결제목적물 또는 결제대금이 인도된 경우에 해당 청산대상업자가 그 결제를 이행하지 아니함으로써 금융투자상품거래청산회사에 손해를 끼친 때에는 그 청산대상업자의 재산에 관하여 다른 채권자보다 우선하여 변제를 받을 권리가 있다. 다만, 그 결제의 이행 기한이 도래하기 전에 설정된 전세권ㆍ질권ㆍ저당권 또는 「동산ㆍ채권 등의 담보에 관한 법률」에 따른 담보권에 의하여 담보된 채권에 대하여는 우선하여 변제를 받을 권리가 없다.
