자본시장과 금융투자업에 관한 법률 제395조(회원보증금)

① 회원은 장래 증권시장 또는 파생상품시장에서의 매매거래와 관련하여 발생할 수 있는 채무의 이행을 보증하기 위하여 거래소에 회원보증금을 예치하여야 한다.

② 거래소는 제398조에 따라 회원을 대신하여 채무를 이행 또는 인수함으로써 취득한 채권을 그 회원에 대한 회원보증금과 상계하여서는 아니 된다.

③ 회원에게 증권 또는 장내파생상품의 매매를 위탁한 자는 그 위탁으로 발생한 채권에 대하여 그 회원의 회원보증금에 관하여 다른 채권자보다 우선하여 변제받을 권리가 있다.

④ 제1항에 따른 회원보증금의 최저한도ㆍ운용 및 관리 등에 관하여 필요한 사항은 거래소의 회원관리규정으로 정한다.
